  1. LIMITED WARRANTY

M Series, A Series & STIL for United States and Canada

Bullfrog International, LC (“Bullfrog” or “we”) extends the following coverage under this Limited Warranty solely to the original end-user purchaser (“Owner” or “you”) of any 2023 model year and later M Series, A Series or STIL Bullfrog Spas hot tub manufactured on or after February 1, 2023 and installed for residential use in the United States or Canada.

LIFETIME WARRANTY

ENDURAFRAME™

Bullfrog warrants the EnduraFrame (injection-molded spa frame) against degradation for the life of the original retail purchaser of the spa.

10 YEAR WARRANTY

SHELL STRUCTURE

Bullfrog warrants the Bullfrog Spa shell will not leak for ten years from the original spa purchase date.

7 YEAR WARRANTY

SHELL SURFACE

Bullfrog warrants the surface finish of the Bullfrog Spa will not crack, craze wrinkle, blister, peel or delaminate for seven years from the original spa purchase date.

5 YEAR WARRANTY

EQUIPMENT

This warranty specifically covers the pump(s), heater, control system, Snap Caps™, FilterCap™, other Bullfrog mechanical equipment (excluding any equipment listed in other sections), and leaks from any component or plumbing fitting located beneath the spa shell.

Electrical and mechanical equipment with its associated piping and fittings are warranted against defects in materials and workmanship for five years from purchase date.

Defective components that are easily removed from the spa and that can be readily replaced by the customer and do not require specialized tools or knowledge or create personal safety issues, all of which are referred to as “Easily Removed Components,” will be repaired or replaced free of charge at your authorized Bullfrog Spas dealer or retail store or by sending the defective component(s) to Bullfrog. This warranty excludes audio systems, water care systems, and the interior and exterior spa lighting systems.

SPA CABINET and BASE

This warranty specifically covers the cabinet corners, door and side panels, and the molded spa base.

Cabinet sections (corners, doors, side panels) are warranted against material degradation and cracking for five years from purchase date.

JETPAK THERAPY SYSTEM®
This warranty specifically covers the jets, any leaks from JetPak jet fittings, and the JetPak manifold system.
The JetPak manifold system is warranted for five years from purchase date.

Color availability on replacement and aftermarket JetPaks may vary and will depend upon market demand and availability of the color to Bullfrog.

3 YEAR WARRANTY

PATIO PERFORMANCE™ SPA COVER
Bullfrog warrants the Patio Performance spa cover against defects in materials or workmanship, unless determined to be normal fading or wear, for three years from the original spa purchase date.

1 YEAR WARRANTY

LIGHTING SYSTEMS
Bullfrog warrants the interior and exterior spa lighting systems against defects in materials and workmanship for one year from the original spa purchase date. Lighting components that are Easily Removed Components, such as exterior sconce lights, will be repaired or replaced free of charge at your authorized Bullfrog Spa dealer or retail store or by sending the defective component(s) to Bullfrog.
AUDIO SYSTEMS
Bullfrog warrants audio systems against defects in materials and workmanship for one year from the original spa purchase date.
WATER CARE SYSTEMS
Bullfrog warrants water care systems against defects in materials and workmanship for one year from the original spa purchase date.

OTHER WARRANTIES

Bullfrog warrants the Bullfrog Spa pillows, metal jet faces, and filters against defects in materials and workmanship through time of delivery.

WARRANTY PERFORMANCE and TERMS

Bullfrog or its authorized agent (i.e., personnel of Bullfrog, its retail dealers, or its authorized third-party service companies) will repair or replace any malfunctioning or defective component on the spa that is covered under the terms of this Limited Warranty and was purchased from an authorized Bullfrog Spas dealer or retail store. Bullfrog reserves the right, at its option, to either repair or replace a defective spa or component. Owner is required to maintain clear access for spa repairs and is responsible for any non-standard costs of accessing spa equipment or spa plumbing. When warranty service requires removal of the spa, Owner will be responsible for any non-standard costs of spa removal and replacement, such as for spas located in a vault, spas located on an upper deck where a crane is required, or repair or replacement of decking or surrounding stone or concrete.
If a replacement spa or component is provided by Bullfrog, Owner will be responsible for all costs for removal and replacement of the defective product, mileage charges, shipping costs of the replacement product, and delivery. In the event of a structure or frame failure after seven years from the original spa purchase date, the defective spa must be sent to Bullfrog for repair at Owner’s expense. In some situations, the servicing dealer or Bullfrog may charge Owner a reasonable service fee.
Bullfrog reserves the right to use either new or reconditioned replacement components. Any repair or replacement component or spa does not receive new or extended warranty coverage but is covered only under the remaining portion of the original product’s warranty term.
Bullfrog’s Lifetime warranties last for the lifetime of the original retail purchaser of the spa. If the original retail purchaser is a company or entity rather than a natural person (e.g., corporation, limited liability company, family trust, etc.), “life of the original retail purchaser” shall mean ten years.
To obtain warranty service, contact your authorized Bullfrog Spas dealer or Bullfrog and submit proof of purchase. The proof of purchase requirement may be waived if Bullfrog’s or the dealer’s records can confirm the original spa purchase date and that you are the original purchaser. Any defective spa or component sent directly to the factory for warranty repair must be preauthorized by Bullfrog and must be freight prepaid. Return freight will be paid by Bullfrog on all warranted components and spas, except that Owner is responsible for all shipping charges for any spa returned for repairs more than seven years after its purchase date. When the entire spa is sent to the factory for repair, all costs of removing and re-installing the spa at Owner’s location will be the responsibility of Owner. Repair or replacement, as described above, shall be Bullfrog’s sole liability for any breach of this Limited Warranty.

EXCLUSIONS

This Bullfrog Spa Limited Warranty is void in the following circumstances:
▪ The spa has been subject to neglect, misuse or abuse, or to alterations that cause the damage.
▪ Damage is caused by repair or maintenance work that has been attempted or done by anyone other than an authorized agent of Bullfrog.
▪ The spa has been used in a non-residential or commercial location (including where a spa may be used by multiple residents of an apartment or townhome complex) or in any way for which it was not designed.
▪ Damage is caused by an act of God (fire, earthquake, hail, etc.) or any other cause beyond the control of Bullfrog.
▪ Damage is caused by the addition or use of any non-approved mechanical or electrical component, or chemical substance.
▪ Damage is caused by shipping, moving, mishandling, improper installation or electrical hook-up by someone other than an authorized agent of Bullfrog.
▪ Damage to the spa shell is caused by excessive heat build-up due to failure to properly cover the spa when it is empty of water or exposed to direct sunlight or other weather conditions.
▪ Damage is caused by operating the spa outside the water temperature range of 40°F – 110°F (4°C-43°C).
▪ Damage is caused by improper maintenance of spa water chemistry or by allowing undissolved spa chemicals to lie on the spa’s surface.
▪ Damage is caused by failure to install, maintain and operate the spa in accordance with the recommendations contained in the Bullfrog Owner’s Manual, Pre-Delivery Guide or any other printed instructions, notice or bulletin from Bullfrog.
▪ Damage is caused by failure to provide a proper spa foundation as described in the Pre-Delivery Guide. Any person or company may perform necessary maintenance or repairs on a Bullfrog spa. However, any damages caused by you or anyone other than Bullfrog or its authorized agents are not covered and may void this Limited Warranty.

LIMITATIONS

THIS LIMITED WARRANTY STATES BULLFROG’S SOLE LIABILITY AND OBLIGATION FOR ANY SPA PROBLEMS OR MALFUNCTIONS AND FOR ANY WARRANTY BREACHES. THIS LIMITED WARRANTY TAKES THE PLACE OF ALL OTHER WARRANTIES, INCLUDING ANY EXPRESS OR STATUTORY WARRANTIES. ANY IMPLIED WARRANTIES (SUCH AS IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED TO THE STATUTORY PERIOD OR THE DURATION OF THE APPLICABLE WARRANTY STATED ABOVE, WHICHEVER IS SHORTER. NO AGENT, DEALER, DISTRIBUTOR, SERVICE COMPANY OR OTHER PARTY IS AUTHORIZED TO CHANGE, MODIFY OR EXTEND THE TERMS OF THIS LIMITED WARRANTY IN ANY MANNER WHATSOEVER. THIS LIMITED WARRANTY TERMINATES UPON TRANSFER OF SPA OWNERSHIP. BULLFROG MAY, AT ITS OPTION, EITHER REPAIR OR REPLACE A DEFECTIVE PRODUCT (SPA OR A COMPONENT). IF THE SPA NEEDS TO BE REPLACED BUT THE CURRENT MARKET PRICE OF THE REPLACEMENT SPA IS GREATER THAN THE ORIGINAL SPA’S MARKET PRICE, OWNER WILL BE REQUIRED TO EITHER PAY AN UPGRADE FEE OR CHOOSE A REPLACEMENT SPA COMPARABLE TO THE MARKET PRICE OF THE ORIGINAL SPA AT THE TIME OF ITS PURCHASE. THE ORIGINAL WARRANTY PERIOD WILL CONTINUE TO APPLY TO ALL REPAIRED AND REPLACEMENT SPAS AND COMPONENTS AND WILL NOT BE RENEWED OR EXTENDED FOR ANY REASON.

DISCLAIMERS

EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY OR OTHERWISE REQUIRED BY APPLICABLE LAW, BULLFROG AND ITS AUTHORIZED AGENTS SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, DEATH, DAMAGES TO PROPERTY, LOSS, COST OR OTHER DAMAGE, WHETHER DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE, ARISING OUT OF THE SPAS, BULLFROG’S OR ITS AGENTS’ SERVICES, OR ANY DEFECT COVERED BY THIS LIMITED WARRANTY, INCLUDING WITHOUT LIMITATION LOSS OF USE OF THE SPA AND COST FOR REMOVAL OF DEFECTIVE PRODUCTS, EVEN IF BULLFROG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS REQUIRED BY LAW, THE TOTAL LIABILITY OF BULLFROG AND ITS AUTHORIZED AGENTS TO YOU OR THIRD PARTIES SHALL NOT EXCEED THE ORIGINAL AMOUNT PAID FOR THE DEFECTIVE PRODUCT.

This Limited Warranty gives you specific legal rights. You may also have other rights under the laws of your country, state, or province. Some jurisdictions do not allow limitations on certain implied or statutory warranties or other warranty terms and conditions, so these limitations may not apply to you. Prompt return of a completed warranty registration form will help protect your warranty rights. Registration requirements do not apply to residents of California or other
jurisdictions where prohibited by law.

Bullfrog reserves the right, at its option, to either repair or replace a defective spa or component. As Swim Series spas are large and often require complex and/or expensive installation methods and accommodations, all reasonable efforts will be made to repair or replace components on site where the spa is installed. If Bullfrog or its authorized agent determines that onsite repair of the defect or replacement of components is not feasible due to limitations created by the spa installation location, we reserve the right to require removal of the spa from its installation location to ensure safe technician access. In such an event, costs for moving the spa to a workable location and reinstallation of the spa after repairs will be the sole responsibility of Owner, including any non-standard costs of spa removal and replacement, such as for spas located in a vault, spas located on an upper deck where a crane is required, or repair or replacement of decking or surrounding stone or concrete. In the rare case that a replacement spa is required to adequately address the defect or malfunction, Owner will be solely responsible for removal costs, shipping costs of the replacement product, and delivery costs to the installation location.

EQUIPMENT
This warranty specifically covers the pump(s), heater, control system, FilterCap™, other Bullfrog mechanical equipment (excluding any equipment listed in other sections), and leaks from any component or plumbing fitting located beneath the spa shell.
Electrical and mechanical equipment with its associated piping and fittings are warranted against defects in materials and workmanship for three years from purchase date. Defective components that are easily removed from the spa and that can be readily replaced by the customer and do not require specialized tools or knowledge or create personal safety issues, all of which are referred to as “Easily Removed Components,” will be repaired or replaced free of charge at your authorized Bullfrog Spas dealer or retail store or by sending the defective
component(s) to Bullfrog. This warranty excludes audio systems, water care systems, and the interior and exterior spa lighting systems.
SPA CABINET
This warranty specifically covers the cabinet corners, door and side panels.
Cabinet sections (corners, doors, side panels) are warranted against material degradation and cracking for three years from purchase date.
PATIO PERFORMANCE™ SPA COVER
Bullfrog warrants the Patio Performance spa cover against defects in materials or workmanship, unless determined to be normal fading or wear, for three years from the original spa purchase date.

1 YEAR WARRANTY

LIGHTING SYSTEMS
Bullfrog warrants the interior and exterior spa lighting systems against defects in materials and workmanship for one year from the original spa purchase date. Lighting components that are Easily Removed Components, such as exterior sconce lights, will be repaired or replaced free of charge at your authorized Bullfrog Spa dealer or retail store or by sending the defective component(s) to Bullfrog.
AUDIO SYSTEMS
Bullfrog warrants audio systems against defects in materials and workmanship for one year from the original spa purchase date.
WATER CARE SYSTEMS
Bullfrog warrants water care systems against defects in materials and workmanship for one year from the original spa purchase date.

OTHER WARRANTIES

Bullfrog warrants the Bullfrog Spa pillows, metal jet faces, and filters against defects in materials and workmanship through time of delivery.


WARRANTY PERFORMANCE and TERMS

Bullfrog or its authorized agent (i.e., personnel of Bullfrog, its retail dealers, or its authorized third-party service companies) will repair or replace any malfunctioning or defective component on the spa that is covered under the terms of this Limited Warranty and was purchased from an authorized Bullfrog Spas dealer or retail store. Bullfrog reserves the right, at its option, to either
repair or replace a defective spa or component. Owner is required to maintain clear access for spa repairs and is responsible for any non-standard costs of accessing spa equipment or spa plumbing. When warranty service requires removal of the spa, Owner will be responsible for any non-standard costs of spa removal and replacement, such as for spas located in a vault, spas located on an upper deck where a crane is required, or repair or replacement of decking or
surrounding stone or concrete.
If a replacement spa or component is provided by Bullfrog, Owner will be responsible for all costs for removal and replacement of the defective product, mileage charges, shipping costs of the replacement product, and delivery. In the event of a structure or frame failure after seven years from the original spa purchase date, the defective spa must be sent to Bullfrog for repair at
Owner’s expense. In some situations, the servicing dealer or Bullfrog may charge Owner a reasonable service fee.
Bullfrog reserves the right to use either new or reconditioned replacement components. Any repair or replacement component or spa does not receive new or extended warranty coverage but is covered only under the remaining portion of the original product’s warranty term.

To obtain warranty service, contact your authorized Bullfrog Spas dealer or Bullfrog and submit proof of purchase. The proof of purchase requirement may be waived if Bullfrog’s or the dealer’s records can confirm the original spa purchase date and that you are the original purchaser. Any defective spa or component sent directly to the factory for warranty repair must be preauthorized by Bullfrog and must be freight prepaid. Return freight will be paid by Bullfrog on all warranted components and spas, except that Owner is responsible for all shipping charges for any spa returned for repairs more than seven years after its purchase date. When the entire spa is sent to the factory for repair, all costs of removing and re-installing the spa at Owner’s location will be the responsibility of Owner. Repair or replacement, as described above, shall be Bullfrog’s sole liability for any breach of this Limited Warranty.

 

EXCLUSIONS

This Bullfrog Spa Limited Warranty is void in the following circumstances:
▪ The spa has been subject to neglect, misuse or abuse, or to alterations that cause the damage.
▪ Damage is caused by repair or maintenance work that has been attempted or done by anyone other than an authorized agent of Bullfrog.
▪ The spa has been used in a non-residential or commercial location (including where a spa may be used by multiple residents of an apartment or townhome complex) or in any way for which it was not designed.
▪ Damage is caused by an act of God (fire, earthquake, hail, etc.) or any other cause beyond the control of Bullfrog.
▪ Damage is caused by the addition or use of any non-approved mechanical or electrical component, or chemical substance.
▪ Damage is caused by shipping, moving, mishandling, improper installation or electrical hook-up by someone other than an authorized agent of Bullfrog.
▪ Damage to the spa shell is caused by excessive heat build-up due to failure to properly cover the spa when it is empty of water or exposed to direct sunlight or other weather conditions.
▪ Damage is caused by operating the spa outside the water temperature range of 40°F-110°F (4°C-43°C).
▪ Damage is caused by improper maintenance of spa water chemistry or by allowing undissolved spa chemicals to lie on the spa’s surface.
▪ Damage is caused by failure to install, maintain and operate the spa in accordance with the recommendations contained in the Bullfrog Owner’s Manual, Pre-Delivery Guide or any other printed instructions, notice or bulletin from Bullfrog.
▪ Damage is caused by failure to provide a proper spa foundation as described in the Pre-Delivery Guide.
Any person or company may perform necessary maintenance or repairs on a Bullfrog spa. However, any damages caused by you or anyone other than Bullfrog or its authorized agents are not covered and may void this Limited Warranty.


LIMITATIONS

THIS LIMITED WARRANTY STATES BULLFROG’S SOLE LIABILITY AND OBLIGATION FOR ANY SPA PROBLEMS OR MALFUNCTIONS AND FOR ANY WARRANTY BREACHES. THIS LIMITED WARRANTY TAKES THE PLACE OF ALL OTHER WARRANTIES, INCLUDING ANY EXPRESS OR STATUTORY WARRANTIES. ANY IMPLIED WARRANTIES (SUCH AS IMPLIED WARRANTIES OF MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED TO THE STATUTORY PERIOD OR THE DURATION OF THE APPLICABLE WARRANTY STATED ABOVE, WHICHEVER IS SHORTER. NO AGENT, DEALER, DISTRIBUTOR, SERVICE COMPANY OR OTHER PARTY IS AUTHORIZED TO CHANGE, MODIFY OR EXTEND THE TERMS OF THIS LIMITED WARRANTY IN ANY MANNER WHATSOEVER. THIS LIMITED WARRANTY TERMINATES UPON TRANSFER OF SPA OWNERSHIP. BULLFROG MAY,
AT ITS OPTION, EITHER REPAIR OR REPLACE A DEFECTIVE PRODUCT (SPA OR A COMPONENT). IF THE SPA NEEDS TO BE REPLACED BUT THE CURRENT MARKET PRICE OF THE REPLACEMENT SPA IS GREATER THAN THE ORIGINAL SPA’S MARKET PRICE, OWNER WILL BE REQUIRED TO EITHER PAY AN UPGRADE FEE OR CHOOSE A REPLACEMENT SPA COMPARABLE TO THE MARKET PRICE OF THE ORIGINAL SPA AT THE TIME OF ITS PURCHASE. THE ORIGINAL WARRANTY PERIOD WILL CONTINUE TO APPLY TO ALL REPAIRED AND REPLACEMENT SPAS AND COMPONENTS AND WILL NOT BE RENEWED OR EXTENDED FOR ANY REASON.
DISCLAIMERS EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY OR OTHERWISE REQUIRED BY APPLICABLE LAW, BULLFROG AND ITS AUTHORIZED AGENTS SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, DEATH, DAMAGES TO PROPERTY, LOSS, COST OR OTHER DAMAGE, WHETHER DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE, ARISING OUT OF THE SPAS, BULLFROG’S OR ITS AGENTS’ SERVICES, OR ANY DEFECT COVERED BY THIS LIMITED WARRANTY, INCLUDING WITHOUT LIMITATION LOSS OF USE OF THE SPA AND COST FOR REMOVAL OF DEFECTIVE PRODUCTS, EVEN IF BULLFROG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS REQUIRED BY LAW, THE TOTAL LIABILITY OF BULLFROG AND ITS AUTHORIZED AGENTS TO YOU OR THIRD PARTIES SHALL NOT EXCEED THE ORIGINAL AMOUNT PAID FOR THE
DEFECTIVE PRODUCT.

This Limited Warranty gives you specific legal rights. You may also have other rights under the laws of your country, state, or province. Some jurisdictions do not allow limitations on certain implied or statutory warranties or other warranty terms and conditions, so these limitations may not apply to you. M Series, A Series & STIL for European Union & United Kingdom Bullfrog International, LC (“Bullfrog” or “we”) extends the following coverage under this Limited Warranty solely to the original end-user purchaser (“Owner” or “you”) of any M Series, A Series or STIL spa manufactured on or after January 1, 2025 and installed for residential use in European Union and the United Kingdom.

Bullfrog warrants the EnduraFrame (injection-molded spa frame) against degradation for ten years from the original spa purchase date.

Electrical and mechanical equipment with its associated piping and fittings are warranted against defects in materials and workmanship for five years from purchase date.
Defective components that are easily removed from the spa and that can be readily replaced by the customer and do not require specialized tools or knowledge or create personal safety issues, all of which are referred to as Easily Removed Components, will be repaired or replaced free of charge at your
authorized Bullfrog Spas dealer. This warranty excludes audio systems, water care systems, and interior and exterior spa lighting systems.

JETPAK THERAPY SYSTEM®
This warranty specifically covers the jets, any leaks from JetPak jet fittings, and the JetPak manifold system.
JetPak manifold system is warranted for five years from purchase date.
Color availability on replacement and aftermarket JetPaks may vary and will depend upon market demand and availability of the color to Bullfrog.

If Bullfrog or its authorized agent determines that repairing the defect is not feasible, Bullfrog or its authorized agent may instead provide a replacement spa or component equal in value to the defective spa or component. In cases where a replacement spa is authorized, Bullfrog will attempt to replace the spa with one of equal market value. If authorized by Bullfrog, you may also be allowed to choose a higher-priced spa by paying the difference between the market value of your original spa at the time of purchase and the current market price of the new replacement spa.
Owner will be responsible for any non-standard costs of spa removal and replacement, such as spas located in a vault, spas located on a balcony or deck where a crane is required, or decking repair or replacement. After six months from the original spa purchase date, Owner will be responsible for all costs for removal and replacement of the defective product, dealer mileage charges, shipping costs of replacement product, and delivery. In the event of a structure or frame failure after three years from the original spa purchase date, the defective spa must be sent to your authorized Bullfrog Spa dealer for repair at the Owner’s expense. In some situations, the servicing dealer or Bullfrog may
charge Owner a reasonable service fee.

To the maximum extent permitted by applicable law, repair or replacement, as described above, shall be Bullfrog’s sole liability and your sole and exclusive remedy for any breach of this Limited Warranty.

EXCLUSIONS

DEATH, OR DAMAGES TO PROPERTY; OR (B) ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE, LOSSES OR COSTS, ARISING OUT OF THE SPAS, BULLFROG’S OR ITS AGENTS’ PRODUCTS OR SERVICES, OR ANY DEFECT COVERED BY THIS LIMITED WARRANTY, INCLUDING WITHOUT LIMITATION, LOSS OF USE OF THE SPA AND COST FOR REMOVAL OF DEFECTIVE PRODUCTS, EVEN IF
BULLFROG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS REQUIRED BY LAW, THE TOTAL LIABILITY OF BULLFROG AND ITS AUTHORIZED AGENTS TO YOU OR THIRD PARTIES ARISING OUT OF OR IN CONNECTION WITH THIS LIMITED WARRANTY, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY OR OTHERWISE SHALL NOT EXCEED THE ORIGINAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT. COVERAGE UNDER THIS LIMITED WARRANTY SHALL COMMENCE ON THE ORIGINAL DATE
OF PURCHASE AND WILL NOT EXTEND FOR ANY REASON WHATSOEVER BEYOND THE STATED TIME PERIOD(S).


LEGAL RIGHTS CONSUMERS

The following applies only if you qualify as a consumer. This Limited Warranty gives you specific legal rights in addition to your statutory rights under applicable consumer protection laws. These statutory rights may vary depending on the laws of your country of residence and are not affected by this
warranty.
Some jurisdictions do not allow limitations on, or exclusions of, certain implied terms and conditions, or liabilities. In those cases, this Limited Warranty does not affect, limit or exclude any statutory rights you may have. Prompt return of a completed warranty registration form will help protect your warranty rights. Registration requirements do not apply to residents of jurisdictions where prohibited by law.

GENERAL

Rights of Third Parties

A person who is not party to this Limited Warranty may not enforce any term of this Limited Warranty under the Contracts (Rights of Third Parties) Act 1999.


Invalidity

If a competent court or administrative body finds that any provision of this Limited Warranty is invalid illegal or unenforceable, it will be excluded from the warranty and the rest of this Limited Warranty
shall remain unaffected and in force.

Assignment

You may not assign, transfer, mortgage, charge, subcontract, delegate, declare a trust over or deal in
any other manner with any of your rights and obligations under this Limited Warranty.


GOVERNING LAW AND JURISDICTION


This Limited Warranty, and any non-contractual obligations arising from or connected with this Limited Warranty, is governed by and construed under Dutch law, without prejudice to any rights you may have under applicable mandatory laws. You and Bullfrog irrevocably agree that the court of
Amsterdam have exclusive jurisdiction to settle any dispute (whether contractual or non-contractual) arising out of or in connection with this Limited Warranty, including as to its existence, validity or termination, unless mandatory applicable laws grant you the right to opt for dispute resolution by a court that would otherwise have jurisdiction under the applicable law.

OTHER WARRANTIES

Bullfrog warrants the Bullfrog Spa pillows, metal jet faces, and filters against defects in materials and workmanship at the time of delivery.

WARRANTY PERFORMANCE and TERMS

Bullfrog or its authorized agent (i.e., personnel of Bullfrog, its retail dealers, or its authorized third party service companies) will repair or replace any malfunctioning or defective component on the Bullfrog spa that is covered under the terms of this Limited Warranty and was purchased from an authorized Bullfrog Spas dealer or retail store. In doing so, Bullfrog reserves the right, at its option, to either repair or replace the defective spa or component. Owner is required to maintain clear access to the spa equipment bay and is responsible for any non-standard costs of accessing spa equipment.
If Bullfrog or its authorized agent determines that repairing the defect is not feasible, Bullfrog or its authorized agent may instead provide a replacement spa or component equal in value to the defective spa or component. In cases where a replacement spa is authorized, Bullfrog will attempt to replace the spa with one of equal market value. If authorized by Bullfrog, you may also be allowed to
choose a higher-priced spa by paying the difference between the market value of your original spa at the time of purchase and the current market price of the new replacement spa.
Owner will be responsible for any non-standard costs of spa removal and replacement, such as spas located in a vault, spas located on a balcony or deck where a crane is required, or decking repair or replacement. After six months from the original spa purchase date, Owner will be responsible for all costs for removal and replacement of the defective product, dealer mileage charges, shipping costs of replacement product, and delivery. In the event of a structure or frame failure after three years from the original spa purchase date, the defective spa must be sent to your authorized Bullfrog Spa dealer for repair at the Owner’s expense. In some situations, the servicing dealer or Bullfrog may
charge Owner a reasonable service fee.
Bullfrog reserves the right to use either new or reconditioned replacement components. Any repair or replacement component or spa does not receive new or extended warranty coverage but is covered only under the remaining portion of the original product’s warranty term.
To obtain warranty service, contact your authorized Bullfrog Spas dealer and submit proof of purchase. The proof of purchase requirement may be waived if Bullfrog’s or the dealer’s records can confirm the original spa purchase date and that you are the original purchaser. Any defective spa or component sent directly to the dealer for warranty repair must be pre-authorized by the dealer or  Bullfrog and must be freight prepaid. Return freight will be paid by Bullfrog on all warranted components and spas, excluding any spa returned that is more than three years after its purchase date. If the entire spa is returned to the dealer for repair, all costs of removing and re-installing the spa at Owner’s location will be the responsibility of the Owner. To the maximum extent permitted by
applicable law, repair or replacement, as described above, shall be Bullfrog’s sole liability and your sole and exclusive remedy for any breach of this Limited Warranty.

EXCLUSIONS

This Bullfrog Spa Limited Warranty is void in the following circumstances:
 The spa has been subject to alteration, neglect, misuse or abuse, or to alterations that cause the damage.
 Damage is caused by repair or maintenance work that has been attempted or done by anyone other than an authorized agent of Bullfrog.
 The spa has been used in a non-residential or commercial location (including where a spa may be used by multiple residents of an apartment or townhome complex) or in any way for which it was not designed.
 Damage is caused by an act of God (fire, earthquake, natural disaster or any other external cause), animal, or by any action or omission attributable to you.
 Damage is caused by the addition or use of any non-approved mechanical or electrical component, or chemical substance.
 Damage is caused by shipping, moving, mishandling, improper installation or electrical hookup by someone other than an authorized agent of Bullfrog.
 Damage to the spa shell is caused by excessive heat build- up due to failure to properly cover the spa when it is empty of water or exposed to direct sunlight or other weather conditions.
 Damage is caused by operating the spa outside the water temperature range of 40°F-110°F (4°C-43°C).
 Damage is caused by improper maintenance of spa water chemistry or by allowing undissolved spa chemicals to lie on the spa’s surface.
 Damage is caused by failure to install, maintain and operate the spa in accordance with the recommendations contained in the Bullfrog Owner’s Manual, Pre-Delivery Guide or any other printed instructions, notice or bulletin from Bullfrog.
Any person or company may perform necessary maintenance or repairs on a Bullfrog spa. However, any damages caused by you or anyone other than Bullfrog or its authorized agents are not covered and may void this Limited Warranty.

LIMITATIONS

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS LIMITED WARRANTY STATES BULLFROG’S SOLE LIABILITY AND OBLIGATION FOR ANY SPA PROBLEMS OR MALFUNCTIONS AND FOR ANY WARRANTY BREACHES AND THIS LIMITED WARRANTY TAKES THE PLACE OF ALL OTHER WARRANTIES, CONDITIONS AND OTHER TERMS NOT SET OUT IN THIS LIMITED WARRANTY, WHICH ARE EXPRESSLY EXCLUDED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES (SUCH AS IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED TO THE STATUTORY PERIOD OR THE DURATION OF THE APPLICABLE WARRANTY STATED ABOVE, WHICHEVER IS SHORTER. NOTHING IN THIS LIMITED WARRANTY EXCLUDES BULLFROG’S LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY BULLFROG’S NEGLIGENCE, FRAUD OR FRAUDULENT MISREPRESENTATION, AND ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED BY LAW.

LEGAL RIGHTS CONSUMERS

The following applies only if you qualify as a consumer. This Limited Warranty gives you specific legal rights in addition to your statutory rights under applicable consumer protection laws. Some jurisdictions do not allow limitations on, or exclusions of, certain implied terms and conditions, or liabilities. In those cases, this Limited Warranty does not affect, limit or exclude any statutory rights you may have. Prompt return of a completed warranty registration form will help protect your warranty rights. Registration requirements do not apply to residents of jurisdictions where prohibited by law.

GENERAL

Rights of Third Parties

A person who is not party to this Limited Warranty may not enforce any term of this Limited Warranty under the Contracts (Rights of Third Parties) Act 1999.

Invalidity

If a competent court or administrative body finds that any provision of this Limited Warranty is invalid illegal or unenforceable, it will be excluded from the warranty and the rest of this Limited Warranty shall remain unaffected and in force.

Assignment

You may not assign, transfer, mortgage, charge, subcontract, delegate, declare a trust over or deal in any other manner with any of your rights and obligations under this Limited Warranty. 

GOVERNING LAW AND JURISDICTION

This Limited Warranty, and any non-contractual obligations arising from or connected with this Limited Warranty, is governed by and construed under Dutch law, without prejudice to any rights you may have under applicable mandatory laws. You and Bullfrog irrevocably agree that the court of Amsterdam have exclusive jurisdiction to settle any dispute (whether contractual or non-contractual) arising out of or in connection with this Limited Warranty, including as to its existence, validity or termination, unless mandatory applicable laws grant you the right to opt for dispute resolution by a court that would otherwise have jurisdiction under the applicable law.

M Series, A Series & STIL for United States and Canada

Bullfrog International, LC (“Bullfrog” or “we”) extends the following coverage under this Limited Warranty solely to the original end-user purchaser (“Owner” or “you”) of any 2023 model year and later M Series, A Series or STIL Bullfrog Spas hot tub manufactured on or after February 1, 2023 and installed for residential use in the United States or Canada.

LIFETIME WARRANTY

ENDURAFRAME™

Bullfrog warrants the EnduraFrame (injection-molded spa frame) against degradation for the life of the original retail purchaser of the spa.

10 YEAR WARRANTY

SHELL STRUCTURE

Bullfrog warrants the Bullfrog Spa shell will not leak for ten years from the original spa purchase date.

7 YEAR WARRANTY

SHELL SURFACE

Bullfrog warrants the surface finish of the Bullfrog Spa will not crack, craze wrinkle, blister, peel or delaminate for seven years from the original spa purchase date.

5 YEAR WARRANTY

EQUIPMENT

This warranty specifically covers the pump(s), heater, control system, Snap Caps™, FilterCap™, other Bullfrog mechanical equipment (excluding any equipment listed in other sections), and leaks from any component or plumbing fitting located beneath the spa shell.

Electrical and mechanical equipment with its associated piping and fittings are warranted against defects in materials and workmanship for five years from purchase date.

Defective components that are easily removed from the spa and that can be readily replaced by the customer and do not require specialized tools or knowledge or create personal safety issues, all of which are referred to as “Easily Removed Components,” will be repaired or replaced free of charge at your authorized Bullfrog Spas dealer or retail store or by sending the defective component(s) to Bullfrog. This warranty excludes audio systems, water care systems, and the interior and exterior spa lighting systems.

SPA CABINET and BASE

This warranty specifically covers the cabinet corners, door and side panels, and the molded spa base.

Cabinet sections (corners, doors, side panels) are warranted against material degradation and cracking for five years from purchase date.

JETPAK THERAPY SYSTEM®
This warranty specifically covers the jets, any leaks from JetPak jet fittings, and the JetPak manifold system.
The JetPak manifold system is warranted for five years from purchase date.

Color availability on replacement and aftermarket JetPaks may vary and will depend upon market demand and availability of the color to Bullfrog.

3 YEAR WARRANTY

PATIO PERFORMANCE™ SPA COVER
Bullfrog warrants the Patio Performance spa cover against defects in materials or workmanship, unless determined to be normal fading or wear, for three years from the original spa purchase date.

1 YEAR WARRANTY

LIGHTING SYSTEMS
Bullfrog warrants the interior and exterior spa lighting systems against defects in materials and workmanship for one year from the original spa purchase date. Lighting components that are Easily Removed Components, such as exterior sconce lights, will be repaired or replaced free of charge at your authorized Bullfrog Spa dealer or retail store or by sending the defective component(s) to Bullfrog.
AUDIO SYSTEMS
Bullfrog warrants audio systems against defects in materials and workmanship for one year from the original spa purchase date.
WATER CARE SYSTEMS
Bullfrog warrants water care systems against defects in materials and workmanship for one year from the original spa purchase date.

OTHER WARRANTIES

Bullfrog warrants the Bullfrog Spa pillows, metal jet faces, and filters against defects in materials and workmanship through time of delivery.

WARRANTY PERFORMANCE and TERMS

Bullfrog or its authorized agent (i.e., personnel of Bullfrog, its retail dealers, or its authorized third-party service companies) will repair or replace any malfunctioning or defective component on the spa that is covered under the terms of this Limited Warranty and was purchased from an authorized Bullfrog Spas dealer or retail store. Bullfrog reserves the right, at its option, to either repair or replace a defective spa or component. Owner is required to maintain clear access for spa repairs and is responsible for any non-standard costs of accessing spa equipment or spa plumbing. When warranty service requires removal of the spa, Owner will be responsible for any non-standard costs of spa removal and replacement, such as for spas located in a vault, spas located on an upper deck where a crane is required, or repair or replacement of decking or surrounding stone or concrete.
If a replacement spa or component is provided by Bullfrog, Owner will be responsible for all costs for removal and replacement of the defective product, mileage charges, shipping costs of the replacement product, and delivery. In the event of a structure or frame failure after seven years from the original spa purchase date, the defective spa must be sent to Bullfrog for repair at Owner’s expense. In some situations, the servicing dealer or Bullfrog may charge Owner a reasonable service fee.
Bullfrog reserves the right to use either new or reconditioned replacement components. Any repair or replacement component or spa does not receive new or extended warranty coverage but is covered only under the remaining portion of the original product’s warranty term.
Bullfrog’s Lifetime warranties last for the lifetime of the original retail purchaser of the spa. If the original retail purchaser is a company or entity rather than a natural person (e.g., corporation, limited liability company, family trust, etc.), “life of the original retail purchaser” shall mean ten years.
To obtain warranty service, contact your authorized Bullfrog Spas dealer or Bullfrog and submit proof of purchase. The proof of purchase requirement may be waived if Bullfrog’s or the dealer’s records can confirm the original spa purchase date and that you are the original purchaser. Any defective spa or component sent directly to the factory for warranty repair must be preauthorized by Bullfrog and must be freight prepaid. Return freight will be paid by Bullfrog on all warranted components and spas, except that Owner is responsible for all shipping charges for any spa returned for repairs more than seven years after its purchase date. When the entire spa is sent to the factory for repair, all costs of removing and re-installing the spa at Owner’s location will be the responsibility of Owner. Repair or replacement, as described above, shall be Bullfrog’s sole liability for any breach of this Limited Warranty.

EXCLUSIONS

This Bullfrog Spa Limited Warranty is void in the following circumstances:

▪ Damage is caused by failure to provide a proper spa foundation as described in the Pre-Delivery Guide. Any person or company may perform necessary maintenance or repairs on a Bullfrog spa. However, any damages caused by you or anyone other than Bullfrog or its authorized agents are not covered and may void this Limited Warranty.

LIMITATIONS

THIS LIMITED WARRANTY STATES BULLFROG’S SOLE LIABILITY AND OBLIGATION FOR ANY SPA PROBLEMS OR MALFUNCTIONS AND FOR ANY WARRANTY BREACHES. THIS LIMITED WARRANTY TAKES THE PLACE OF ALL OTHER WARRANTIES, INCLUDING ANY EXPRESS OR STATUTORY WARRANTIES. ANY IMPLIED WARRANTIES (SUCH AS IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED TO THE STATUTORY PERIOD OR THE DURATION OF THE APPLICABLE WARRANTY STATED ABOVE, WHICHEVER IS SHORTER. NO AGENT, DEALER, DISTRIBUTOR, SERVICE COMPANY OR OTHER PARTY IS AUTHORIZED TO CHANGE, MODIFY OR EXTEND THE TERMS OF THIS LIMITED WARRANTY IN ANY MANNER WHATSOEVER. IF THE SPA NEEDS TO BE REPLACED BUT THE CURRENT MARKET PRICE OF THE REPLACEMENT SPA IS GREATER THAN THE ORIGINAL SPA’S MARKET PRICE, OWNER WILL BE REQUIRED TO EITHER PAY AN UPGRADE FEE OR CHOOSE A REPLACEMENT SPA COMPARABLE TO THE MARKET PRICE OF THE ORIGINAL SPA AT THE TIME OF ITS PURCHASE. THE ORIGINAL WARRANTY PERIOD WILL CONTINUE TO APPLY TO ALL REPAIRED AND REPLACEMENT SPAS AND COMPONENTS AND WILL NOT BE RENEWED OR EXTENDED FOR ANY REASON.

Bullfrog garantisce i sistemi di cura dell’acqua contro difetti di materiali e lavorazione per un anno dalla data di acquisto originale della spa.

ALTRE GARANZIE

Bullfrog garantisce i cuscini Bullfrog Spa, le facce dei getti in metallo, gli ancoraggi accessori, gli skimmer, i rivestimenti per sedili e pavimenti e i filtri contro difetti di materiale e lavorazione fino al momento della consegna.

GARANZIA PRESTAZIONI e TERMINI

Bullfrog o il suo agente autorizzato (ovvero il personale di Bullfrog, dei suoi rivenditori al dettaglio o delle sue società di servizi di terze parti autorizzate) riparerà o sostituirà qualsiasi componente malfunzionante o difettoso della spa coperto dai termini della presente Garanzia Limitata e acquistato da un rivenditore o negozio al dettaglio autorizzato Bullfrog Spas. Bullfrog si riserva il diritto, a sua discrezione, di riparare o sostituire una spa o un componente difettoso. Il proprietario è tenuto a mantenere un accesso libero per le riparazioni della spa ed è responsabile di eventuali costi non standard per l’accesso alle attrezzature della spa o all’impianto idraulico della spa.
Se una spa o un componente sostitutivo viene fornito da Bullfrog, il Proprietario sarà responsabile di tutti i costi per la rimozione e la sostituzione del prodotto difettoso, delle spese di chilometraggio, dei costi di spedizione del prodotto sostitutivo e della consegna. In caso di guasto della struttura o del telaio dopo sette anni dalla data di acquisto della spa originale, la spa difettosa deve essere inviata a Bullfrog per la riparazione a spese del proprietario. In alcune situazioni, il rivenditore di assistenza o Bullfrog possono addebitare al Proprietario una commissione di servizio ragionevole.
Poiché le spa della serie Swim sono grandi e spesso richiedono metodi di installazione e sistemazioni complessi e/o costosi, verranno compiuti tutti gli sforzi ragionevoli per riparare o sostituire i componenti in loco in cui è installata la spa. Se Bullfrog o il suo agente autorizzato stabiliscono che la riparazione in loco del difetto o la sostituzione dei componenti non è fattibile a causa delle limitazioni create dal luogo di installazione della spa, ci riserviamo il diritto di richiedere la rimozione della spa dal suo luogo di installazione per garantire un accesso sicuro ai tecnici. In tal caso, i costi per lo spostamento della spa in un luogo praticabile e la reinstallazione della spa dopo le riparazioni saranno a carico esclusivo del Proprietario, inclusi eventuali costi non standard per la rimozione e la sostituzione della spa, come per le spa situate in un caveau, le spa situate su un ponte superiore dove è richiesta una gru o la riparazione o la sostituzione del piano di calpestio o della pietra o del cemento circostante. Nel raro caso in cui sia necessaria una spa sostitutiva per affrontare adeguatamente il difetto o il malfunzionamento, il Titolare sarà l’unico responsabile dei costi di rimozione, dei costi di spedizione del prodotto sostitutivo e dei costi di consegna al luogo di installazione.
Bullfrog si riserva il diritto di utilizzare componenti di ricambio nuovi o ricondizionati. Qualsiasi riparazione o sostituzione di componenti o spa non riceve una copertura di garanzia nuova o estesa, ma è coperta solo dalla parte rimanente del periodo di garanzia del prodotto originale.
Le garanzie a vita di Bullfrog durano per tutta la vita dell’acquirente al dettaglio originale della spa. Se l’acquirente al dettaglio originario è una società o un’entità piuttosto che una persona fisica (ad esempio, società, società a responsabilità limitata, trust familiare, ecc.), per “durata dell’acquirente al dettaglio originario” si intende dieci anni.
Per ottenere il servizio di garanzia, contattare il rivenditore autorizzato Bullfrog Spas o Bullfrog e inviare la prova d’acquisto. Il requisito della prova d’acquisto può essere derogato se i registri di Bullfrog o del rivenditore possono confermare la data di acquisto originale della spa e che tu sei l’acquirente originale. Qualsiasi spa o componente difettoso inviato direttamente alla fabbrica per la riparazione in garanzia deve essere preautorizzato da Bullfrog e deve essere prepagato in porto assegnato. Il trasporto di ritorno sarà pagato da Bullfrog su tutti i componenti e le spa in garanzia, ad eccezione del fatto che il Proprietario è responsabile di tutte le spese di spedizione per qualsiasi spa restituita per riparazioni più di sette anni dopo la data di acquisto. Quando l’intera spa viene inviata alla fabbrica per la riparazione, tutti i costi di rimozione e reinstallazione della spa presso la sede del Proprietario saranno a carico del Proprietario. La riparazione o la sostituzione, come descritto sopra, sarà di esclusiva responsabilità di Bullfrog per qualsiasi violazione della presente Garanzia Limitata.

ESCLUSIONI

La presente Garanzia Limitata Bullfrog Spa è nulla nelle seguenti circostanze:
▪ La spa è stata oggetto di negligenza, uso improprio o abuso, o di alterazioni che ne hanno causato il danno.
▪ Il danno è causato da lavori di riparazione o manutenzione che sono stati tentati o eseguiti da soggetti diversi da un agente autorizzato di Bullfrog.
▪ La spa è stata utilizzata in un luogo non residenziale o commerciale (anche dove una spa
può essere utilizzato da più residenti di un appartamento o di un complesso di villette a schiera) o in qualsiasi modo per il quale non è stato progettato.
▪ Il danno è causato da un atto di forza maggiore (incendio, terremoto, grandine, ecc.) o da qualsiasi altra causa al di fuori del controllo di Bullfrog.
▪ Il danno è causato dall’aggiunta o dall’uso di qualsiasi componente meccanico o elettrico o sostanza chimica non approvata.
▪ La spa è stata spostata dalla sua posizione di installazione originale.
▪ I danni sono causati da spedizione, spostamento, uso improprio, installazione impropria o collegamento elettrico da parte di persone diverse da un agente autorizzato di Bullfrog.
▪ I danni all’involucro della spa sono causati da un eccessivo accumulo di calore dovuto alla mancata copertura adeguata della spa quando è priva d’acqua o esposta alla luce solare diretta o ad altre condizioni atmosferiche.
▪ Il funzionamento della spa al di fuori dell’intervallo di temperatura dell’acqua è causato da 40°F-110°F (4°C-43°C).
▪ I danni sono causati da una manutenzione impropria della chimica dell’acqua termale o dal fatto che le sostanze chimiche termali non disciolte si depositano sulla superficie della spa.
▪ Il danno è causato dalla mancata installazione, manutenzione e funzionamento della spa in conformità con le raccomandazioni contenute nel Manuale del proprietario di Bullfrog, nella Guida alla pre-consegna o in qualsiasi altra istruzione stampata, avviso o bollettino di Bullfrog.
▪ Il danno è causato dalla mancata fornitura di un’adeguata base spa come descritto nella Guida pre-consegna.

Qualsiasi persona o azienda può eseguire la manutenzione o le riparazioni necessarie su una spa Bullfrog. Tuttavia, eventuali danni causati dall’utente o da chiunque non sia Bullfrog o i suoi agenti autorizzati non sono coperti e possono invalidare la presente Garanzia Limitata.

LIMITAZIONI

LA PRESENTE GARANZIA LIMITATA STABILISCE L’ESCLUSIVA RESPONSABILITÀ E L’OBBLIGO DI BULLFROG PER EVENTUALI PROBLEMI O MALFUNZIONAMENTI DELLA SPA E PER EVENTUALI VIOLAZIONI DELLA GARANZIA. LA PRESENTE GARANZIA LIMITATA SOSTITUISCE TUTTE LE ALTRE GARANZIE, COMPRESE EVENTUALI GARANZIE ESPLICITE O LEGALI. EVENTUALI GARANZIE IMPLICITE (COME LE GARANZIE IMPLICITE DI COMMERCIABILITÀ E IDONEITÀ PER UNO SCOPO PARTICOLARE) SONO LIMITATE AL PERIODO LEGALE O ALLA DURATA DELLA GARANZIA APPLICABILE SOPRA INDICATA, A SECONDA DI QUALE SIA LA PIÙ BREVE. NESSUN AGENTE, RIVENDITORE, DISTRIBUTORE, SOCIETÀ DI SERVIZI O ALTRA PARTE È AUTORIZZATO A CAMBIARE, MODIFICARE O ESTENDERE I TERMINI DELLA PRESENTE GARANZIA LIMITATA IN ALCUN MODO. LA PRESENTE GARANZIA LIMITATA TERMINA AL MOMENTO DEL TRASFERIMENTO DELLA PROPRIETÀ DELLA SPA. BULLFROG PUÒ, A SUA DISCREZIONE, RIPARARE O SOSTITUIRE UN PRODOTTO DIFETTOSO (SPA O UN COMPONENTE). SE LA SPA DEVE ESSERE SOSTITUITA MA L’ATTUALE PREZZO DI MERCATO DELLA SPA SOSTITUTIVA È SUPERIORE AL PREZZO MSTKRY DELLA SPA ORIGINALE, IL PROPRIETARIO SARÀ TENUTO A PAGARE UNA TARIFFA DI AGGIORNAMENTO O A SCEGLIERE UNA SPA SOSTITUTIVA PARAGONABILE AL PREZZO DI MERCATO DELLA SPA ORIGINALE AL MOMENTO DELL’ACQUISTO. IL PERIODO DI GARANZIA ORIGINALE CONTINUERÀ AD APPLICARSI A TUTTE LE SPA E I COMPONENTI RIPARATI E SOSTITUTIVI E NON SARÀ RINNOVATO O ESTESO PER NESSUN MOTIVO.
AD ECCEZIONE DI QUANTO STABILITO NELLA PRESENTE GARANZIA LIMITATA O ALTRIMENTI RICHIESTO DALLA LEGGE APPLICABILE, BULLFROG E I SUOI AGENTI AUTORIZZATI NON SARANNO RESPONSABILI PER EVENTUALI LESIONI PERSONALI, MORTE, DANNI ALLA PROPRIETÀ, PERDITE, COSTI O ALTRI DANNI, DIRETTI, INCIDENTALI, CONSEQUENZIALI, SPECIALI O PUNITIVI, DERIVANTI DALLE SPA, DAI SERVIZI DI BULLFROG O DEI SUOI AGENTI, O DA QUALSIASI DIFETTO COPERTO DALLA PRESENTE GARANZIA LIMITATA, INCLUSI, A TITOLO ESEMPLIFICATIVO MA NON ESAUSTIVO, LA PERDITA DI UTILIZZO DELLA SPA E I COSTI PER LA RIMOZIONE DEI PRODOTTI DIFETTOSI, ANCHE SE BULLFROG È STATA AVVISATA DELLA POSSIBILITÀ DI TALI DANNI. SALVO QUANTO RICHIESTO DALLA LEGGE, LA RESPONSABILITÀ TOTALE DI BULLFROG E DEI SUOI AGENTI AUTORIZZATI NEI CONFRONTI DELL’UTENTE O DI TERZI NON POTRÀ SUPERARE L’IMPORTO ORIGINARIAMENTE PAGATO PER IL PRODOTTO DIFETTOSO.

DIRITTI LEGALI

La presente Garanzia Limitata conferisce all’utente diritti legali specifici. L’utente potrebbe avere anche altri diritti ai sensi delle leggi del proprio paese, stato o provincia. Alcune giurisdizioni non consentono limitazioni su determinate garanzie implicite o legali o altri termini e condizioni di garanzia, pertanto tali limitazioni potrebbero non essere applicabili all’utente. La pronta restituzione di un modulo di registrazione della garanzia compilato aiuterà a proteggere i tuoi diritti di garanzia. I requisiti di registrazione non si applicano ai residenti della California o di altre giurisdizioni in cui ciò è proibito dalla legge.

Bullfrog International, LC (“Bullfrog” o “noi”) estende la seguente copertura ai sensi della presente Garanzia Limitata esclusivamente all’acquirente finale originale (“Proprietario” o “tu”) di qualsiasi vasca idromassaggio Bullfrog Spas serie X Series 2023 prodotta a partire dal 1° febbraio 2023 e installata
per uso residenziale negli Stati Uniti o in Canada.

5 ANNI DI GARANZIA

STRUTTURA DELLA CALOTTA
Bullfrog garantisce che il guscio della Bullfrog Spa non perderà per cinque anni dalla data di acquisto della spa originale.
ENDURAFRAME™
Bullfrog garantisce l’EnduraFrame (telaio per spa stampato a iniezione) contro il degrado per cinque anni dalla data di acquisto originale della spa.

3 ANNI DI GARANZIA

SUPERFICIE DELLA CALOTTA
Bullfrog garantisce che la finitura superficiale della Bullfrog Spa non si screpola, non si raggrinzisce, non si stropiccia, non si sgualcisce, non si sbuccia o si delamina per tre anni dalla data di acquisto della spa originale.
ATTREZZATURA
Questa garanzia copre specificamente la/e pompa/e, il riscaldatore, il sistema di controllo, il FilterCap™, altre apparecchiature meccaniche Bullfrog (escluse le apparecchiature elencate in altre sezioni) e le perdite da qualsiasi componente o raccordo idraulico situato sotto il guscio della spa.
Le apparecchiature elettriche e meccaniche con le relative tubazioni e raccordi sono garantite contro difetti nei materiali e nella lavorazione per tre anni dalla data di acquisto. I componenti difettosi che possono essere facilmente rimossi dalla spa e che possono essere facilmente sostituiti dal cliente e non richiedono strumenti o conoscenze specializzate o creano problemi di sicurezza personale, tutti denominati “Componenti facilmente rimovibili”, saranno riparati o sostituiti gratuitamente presso il rivenditore o il negozio al dettaglio autorizzato Bullfrog Spas o inviando il difettoso
componente/i a Bullfrog. Questa garanzia esclude i sistemi audio, i sistemi di cura dell’acqua e i sistemi di illuminazione interna ed esterna della spa.
ARMADIO PER SPA
Questa garanzia copre specificamente gli angoli dell’armadio, la porta e i pannelli laterali.
Le sezioni dell’armadio (angoli, porte, pannelli laterali) sono garantite contro il degrado del materiale e le fessurazioni per tre anni dalla data di acquisto.
COPERTURA SPA PATIO PERFORMANCE™
Bullfrog garantisce la copertura della spa Patio Performance contro difetti nei materiali o nella lavorazione, a meno che non si tratti di normale sbiadimento o usura, per tre anni dalla data di acquisto della spa originale.

1 ANNO DI GARANZIA

ILLUMINAZIONE
Bullfrog garantisce i sistemi di illuminazione interna ed esterna della spa contro difetti di materiali e lavorazione per un anno dalla data di acquisto originale della spa. Componenti di illuminazione facilmente rimovibili I componenti, come le luci dell’applique esterna, saranno riparati o sostituiti gratuitamente presso il rivenditore o il negozio al dettaglio autorizzato Bullfrog Spa o inviando i componenti difettosi a Bullfrog.
IMPIANTI AUDIO
Bullfrog garantisce i sistemi audio contro difetti nei materiali e nella lavorazione per un anno dalla data di acquisto originale della spa.
SISTEMI PER LA CURA DELL’ACQUA
Bullfrog garantisce i sistemi di cura dell’acqua contro difetti di materiali e lavorazione per un anno dalla data di acquisto originale della spa.

ALTRE GARANZIE

Bullfrog garantisce i cuscini, le facce in metallo e i filtri Bullfrog Spa contro difetti nei materiali e nella lavorazione durante i tempi di consegna.


GARANZIA PRESTAZIONI e TERMINI

Bullfrog o il suo agente autorizzato (ovvero il personale di Bullfrog, dei suoi rivenditori al dettaglio o delle sue società di servizi di terze parti autorizzate) riparerà o sostituirà qualsiasi componente malfunzionante o difettoso della spa coperto dai termini della presente Garanzia Limitata e acquistato da un rivenditore o negozio al dettaglio autorizzato Bullfrog Spas. Bullfrog si riserva il diritto, a sua discrezione, di
Riparare o sostituire una SPA o un componente difettoso. Il proprietario è tenuto a mantenere un accesso libero per le riparazioni della spa ed è responsabile di eventuali costi non standard per l’accesso alle attrezzature della spa o all’impianto idraulico della spa. Quando il servizio di garanzia richiede la rimozione della spa, il Proprietario sarà responsabile di eventuali costi non standard per la rimozione e la sostituzione della spa, ad esempio per le spa situate in un caveau, le spa situate su un ponte superiore dove è richiesta una gru, o la riparazione o la sostituzione del piano di calpestio o
pietra o cemento circostante.
Se una spa o un componente sostitutivo viene fornito da Bullfrog, il Proprietario sarà responsabile di tutti i costi per la rimozione e la sostituzione del prodotto difettoso, delle spese di chilometraggio, dei costi di spedizione del prodotto sostitutivo e della consegna. In caso di guasto della struttura o del telaio dopo sette anni dalla data di acquisto della spa originale, la spa difettosa deve essere inviata a Bullfrog per la riparazione all’indirizzo
Spese del proprietario. In alcune situazioni, il rivenditore di assistenza o Bullfrog possono addebitare al Proprietario una commissione di servizio ragionevole.
Bullfrog si riserva il diritto di utilizzare componenti di ricambio nuovi o ricondizionati. Qualsiasi riparazione o sostituzione di componenti o spa non riceve una copertura di garanzia nuova o estesa, ma è coperta solo dalla parte rimanente del periodo di garanzia del prodotto originale.

Per ottenere il servizio di garanzia, contattare il rivenditore autorizzato Bullfrog Spas o Bullfrog e inviare la prova d’acquisto. Il requisito della prova d’acquisto può essere derogato se i registri di Bullfrog o del rivenditore possono confermare la data di acquisto originale della spa e che tu sei l’acquirente originale. Qualsiasi spa o componente difettoso inviato direttamente alla fabbrica per la riparazione in garanzia deve essere preautorizzato da Bullfrog e deve essere prepagato in porto assegnato. Il trasporto di ritorno sarà pagato da Bullfrog su tutti i componenti e le spa in garanzia, ad eccezione del fatto che il Proprietario è responsabile di tutte le spese di spedizione per qualsiasi spa restituita per riparazioni più di sette anni dopo la data di acquisto. Quando l’intera spa viene inviata alla fabbrica per la riparazione, tutti i costi di rimozione e reinstallazione della spa presso la sede del Proprietario saranno a carico del Proprietario. La riparazione o la sostituzione, come descritto sopra, sarà di esclusiva responsabilità di Bullfrog per qualsiasi violazione della presente Garanzia Limitata.

ESCLUSIONI

La presente Garanzia Limitata Bullfrog Spa è nulla nelle seguenti circostanze:
▪ La spa è stata oggetto di negligenza, uso improprio o abuso, o di alterazioni che ne hanno causato il danno.
▪ Il danno è causato da lavori di riparazione o manutenzione che sono stati tentati o eseguiti da soggetti diversi da un agente autorizzato di Bullfrog.

Qualsiasi persona o azienda può eseguire la manutenzione o le riparazioni necessarie su una spa Bullfrog. Tuttavia, eventuali danni causati dall’utente o da chiunque non sia Bullfrog o i suoi agenti autorizzati non sono coperti e possono invalidare la presente Garanzia Limitata.


LIMITAZIONI

LA PRESENTE GARANZIA LIMITATA STABILISCE L’ESCLUSIVA RESPONSABILITÀ E L’OBBLIGO DI BULLFROG PER EVENTUALI PROBLEMI O MALFUNZIONAMENTI DELLA SPA E PER EVENTUALI VIOLAZIONI DELLA GARANZIA. LA PRESENTE GARANZIA LIMITATA SOSTITUISCE TUTTE LE ALTRE GARANZIE, COMPRESE EVENTUALI GARANZIE ESPLICITE O LEGALI. EVENTUALI GARANZIE IMPLICITE (COME LE GARANZIE IMPLICITE DI COMMERCIABILITÀ
E IDONEITÀ PER UNO SCOPO PARTICOLARE) SONO LIMITATI AL PERIODO LEGALE O ALLA DURATA DELLA GARANZIA APPLICABILE SOPRA INDICATA, A SECONDA DI QUALE SIA LA PIÙ BREVE. NESSUN AGENTE, RIVENDITORE, DISTRIBUTORE, SOCIETÀ DI SERVIZI O ALTRA PARTE È AUTORIZZATO A CAMBIARE, MODIFICARE O ESTENDERE I TERMINI DELLA PRESENTE GARANZIA LIMITATA IN ALCUN MODO. LA PRESENTE GARANZIA LIMITATA TERMINA AL MOMENTO DEL TRASFERIMENTO DELLA PROPRIETÀ DELLA SPA. BULLFROG MAGGIO,
A SUA DISCREZIONE, RIPARARE O SOSTITUIRE UN PRODOTTO DIFETTOSO (SPA O UN COMPONENTE). SE LA SPA DEVE ESSERE SOSTITUITA MA IL PREZZO DI MERCATO CORRENTE DELLA SPA SOSTITUTIVA È SUPERIORE AL PREZZO DI MERCATO DELLA SPA ORIGINALE, IL PROPRIETARIO SARÀ TENUTO A PAGARE UNA TARIFFA DI AGGIORNAMENTO O A SCEGLIERE UNA SPA SOSTITUTIVA PARAGONABILE AL PREZZO DI MERCATO DELLA SPA ORIGINALE AL MOMENTO DELL’ACQUISTO. IL PERIODO DI GARANZIA ORIGINALE CONTINUERÀ AD APPLICARSI A TUTTE LE SPA E I COMPONENTI RIPARATI E SOSTITUTIVI E NON SARÀ RINNOVATO O ESTESO PER NESSUN MOTIVO.

SALVO QUANTO RICHIESTO DALLA LEGGE, LA RESPONSABILITÀ TOTALE DI BULLFROG E DEI SUOI AGENTI AUTORIZZATI NEI CONFRONTI DELL’UTENTE O DI TERZI NON POTRÀ SUPERARE L’IMPORTO ORIGINARIAMENTE PAGATO PER IL
PRODOTTO DIFETTOSO.

LIMITED WARRANTY

M Series, A Series & STIL for European Union & United Kingdom Bullfrog International, LC (“Bullfrog” or “we”) extends the following coverage under this Limited Warranty solely to the original end-user purchaser (“Owner” or “you”) of any M Series, A Series or STIL spa manufactured on or after January 1, 2025 and installed for residential use in European Union and the United Kingdom.


10 YEAR WARRANTY

ENDURAFRAME™
Bullfrog warrants the EnduraFrame (injection-molded spa frame) against degradation for ten years from the original spa purchase date.
SHELL STRUCTURE
Bullfrog warrants the Bullfrog Spa shell will not leak for ten years from the original spa purchase date.


7 YEAR WARRANTY

SHELL SURFACE
Bullfrog warrants the surface finish of the Bullfrog Spa will not crack, craze, wrinkle, blister, peel ordelaminate for seven years from the original spa purchase date.


5 YEAR WARRANTY

EQUIPMENT
This warranty specifically covers the pump(s), heater, control system, Snap Caps™, FilterCap™, other Bullfrog mechanical equipment (excluding any equipment listed in other sections), and leaks from any component or plumbing fitting located beneath the spa shell.
Electrical and mechanical equipment with its associated piping and fittings are warranted against defects in materials and workmanship for five years from purchase date.
Defective components that are easily removed from the spa and that can be readily replaced by the customer and do not require specialized tools or knowledge or create personal safety issues, all of which are referred to as Easily Removed Components, will be repaired or replaced free of charge at your
authorized Bullfrog Spas dealer. This warranty excludes audio systems, water care systems, and interior and exterior spa lighting systems.
SPA CABINET and BASE
This warranty specifically covers the cabinet corners, door and side panels, and the molded spa base.

Cabinet sections (corners, doors, side panels) are warranted against degradation and cracking for five
years from purchase date. 

EnduraBase™ is warranted against degradation and cracking for five years from purchase date. Defective items will be repaired under the terms of this warranty.
JETPAK THERAPY SYSTEM®
This warranty specifically covers the jets, any leaks from JetPak jet fittings, and the JetPak manifold system.
JetPak manifold system is warranted for five years from purchase date.
Color availability on replacement and aftermarket JetPaks may vary and will depend upon market demand and availability of the color to Bullfrog.

1 YEAR WARRANTY

PATIO PERFORMANCE™ SPA COVER
Bullfrog warrants the Patio Performance spa cover against defects in materials or workmanship,
unless determined to be normal fading or wear, for 1 year from the original spa purchase date.

2 YEAR WARRANTY

LIGHTING SYSTEMS
Bullfrog warrants the interior and exterior spa lighting systems against defects in materials and workmanship for two years from the original spa purchase date. Lighting components that are Easily Removed Components, such as the exterior sconce lights, will be repaired or replaced free of charge at your authorized Bullfrog Spa dealer.
AUDIO SYSTEMS
Bullfrog warrants audio systems against defects in materials and workmanship for two years from the original spa purchase date.
WATER CARE SYSTEMS
Bullfrog warrants water care systems against defects in materials and workmanship for two years from the original spa purchase date.


OTHER WARRANTIES

Bullfrog warrants the Bullfrog Spa pillows, metal jet faces, and filters against defects in materials and workmanship at the time of delivery.

WARRANTY PERFORMANCE and TERMS

Bullfrog or its authorized agent (i.e., personnel of Bullfrog, its retail dealers, or its authorized third party service companies) will repair or replace any malfunctioning or defective component on the Bullfrog spa that is covered under the terms of this Limited Warranty and was purchased from an authorized Bullfrog Spas dealer or retail store. In doing so, Bullfrog reserves the right, at its option, to either repair or replace the defective spa or component. Owner is required to maintain clear access to the spa equipment bay and is responsible for any non-standard costs of accessing spa equipment. If Bullfrog or its authorized agent determines that repairing the defect is not feasible, Bullfrog or its authorized agent may instead provide a replacement spa or component equal in value to the defective spa or component. In cases where a replacement spa is authorized, Bullfrog will attempt to replace the spa with one of equal market value. If authorized by Bullfrog, you may also be allowed to choose a higher-priced spa by paying the difference between the market value of your original spa at the time of purchase and the current market price of the new replacement spa.
Owner will be responsible for any non-standard costs of spa removal and replacement, such as spas located in a vault, spas located on a balcony or deck where a crane is required, or decking repair or replacement. After six months from the original spa purchase date, Owner will be responsible for all costs for removal and replacement of the defective product, dealer mileage charges, shipping costs of replacement product, and delivery. In the event of a structure or frame failure after three years from the original spa purchase date, the defective spa must be sent to your authorized Bullfrog Spa dealer for repair at the Owner’s expense. In some situations, the servicing dealer or Bullfrog may
charge Owner a reasonable service fee.
Bullfrog reserves the right to use either new or reconditioned replacement components. Any repair or replacement component or spa does not receive new or extended warranty coverage but is covered only under the remaining portion of the original product’s warranty term.
To obtain warranty service, contact your authorized Bullfrog Spas dealer and submit proof of purchase. The proof of purchase requirement may be waived if Bullfrog’s or the dealer’s records can confirm the original spa purchase date and that you are the original purchaser. Any defective spa or component sent directly to the dealer for warranty repair must be pre-authorized by the dealer or
Bullfrog and must be freight prepaid. Return freight will be paid by Bullfrog on all warranted components and spas, excluding any spa returned that is more than three years after its purchase date. If the entire spa is returned to the dealer for repair, all costs of removing and re-installing the spa at Owner’s location will be the responsibility of the Owner. To the maximum extent permitted by applicable law, repair or replacement, as described above, shall be Bullfrog’s sole liability and your sole and exclusive remedy for any breach of this Limited Warranty.

EXCLUSIONS

This Bullfrog Spa Limited Warranty is void in the following circumstances:
 The spa has been subject to alteration, neglect, misuse or abuse, or to alterations that cause
the damage.
 Damage is caused by repair or maintenance work that has been attempted or done by anyone other than an authorized agent of Bullfrog.
 The spa has been used in a non-residential or commercial location (including where a spa may be used by multiple residents of an apartment or townhome complex) or in any way for which it was not designed.
 Damage is caused by an act of God (fire, earthquake, natural disaster or any other external cause), animal, or by any action or omission attributable to you.
 Damage is caused by the addition or use of any non-approved mechanical or electrical component, or chemical substance.
 Damage is caused by shipping, moving, mishandling, improper installation or electrical hookup by someone other than an authorized agent of Bullfrog.
 Damage to the spa shell is caused by excessive heat build- up due to failure to properly cover the spa when it is empty of water or exposed to direct sunlight or other weather conditions.
 Damage is caused by operating the spa outside the water temperature range of 40°F-110°F (4°C-43°C).
 Damage is caused by improper maintenance of spa water chemistry or by allowing undissolved spa chemicals to lie on the spa’s surface.
 Damage is caused by failure to install, maintain and operate the spa in accordance with the recommendations contained in the Bullfrog Owner’s Manual, Pre-Delivery Guide or any other printed instructions, notice or bulletin from Bullfrog.
Any person or company may perform necessary maintenance or repairs on a Bullfrog spa. However, any damages caused by you or anyone other than Bullfrog or its authorized agents are not covered and may void this Limited Warranty.


LIMITATIONS

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS LIMITED WARRANTY STATES BULLFROG’S SOLE LIABILITY AND OBLIGATION FOR ANY SPA PROBLEMS OR MALFUNCTIONS AND FOR ANY WARRANTY BREACHES AND THIS LIMITED WARRANTY TAKES THE PLACE OF ALL OTHER WARRANTIES, CONDITIONS AND OTHER TERMS NOT SET OUT IN THIS LIMITED WARRANTY, WHICH
ARE EXPRESSLY EXCLUDED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES (SUCH AS IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED TO THE STATUTORY PERIOD OR THE DURATION OF THE APPLICABLE WARRANTY STATED ABOVE, WHICHEVER IS SHORTER. NO AGENT, DEALER, DISTRIBUTOR,
SERVICE COMPANY OR OTHER PARTY IS AUTHORIZED TO CHANGE, MODIFY OR EXTEND THE TERMS OF THIS LIMITED WARRANTY IN ANY MANNER WHATSOEVER. THIS LIMITED WARRANTY TERMINATES UPON TRANSFER OF SPA OWNERSHIP.
DISCLAIMERS
NOTHING IN THIS LIMITED WARRANTY EXCLUDES BULLFROG’S LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY BULLFROG’S NEGLIGENCE, FRAUD OR FRAUDULENT MISREPRESENTATION, AND ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED BY LAW. EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY OR OTHERWISE REQUIRED BY APPLICABLE LAW, BULLFROG AND ITS AUTHORIZED AGENTS SHALL NOT BE LIABLE FOR: (A) ANY PERSONAL INJURY,
DEATH, OR DAMAGES TO PROPERTY; OR (B) ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE, LOSSES OR COSTS, ARISING OUT OF THE SPAS, BULLFROG’S OR ITS AGENTS’ PRODUCTS OR SERVICES, OR ANY DEFECT COVERED BY THIS LIMITED WARRANTY, INCLUDING WITHOUT LIMITATION, LOSS OF USE OF THE SPA AND COST FOR REMOVAL OF DEFECTIVE PRODUCTS, EVEN IF
BULLFROG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS REQUIRED BY LAW, THE TOTAL LIABILITY OF BULLFROG AND ITS AUTHORIZED AGENTS TO YOU OR THIRD PARTIES ARISING OUT OF OR IN CONNECTION WITH THIS LIMITED WARRANTY, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY OR OTHERWISE SHALL NOT EXCEED THE ORIGINAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT. COVERAGE UNDER THIS LIMITED WARRANTY SHALL COMMENCE ON THE ORIGINAL DATE
OF PURCHASE AND WILL NOT EXTEND FOR ANY REASON WHATSOEVER BEYOND THE STATED TIME PERIOD(S).


LEGAL RIGHTS CONSUMERS

The following applies only if you qualify as a consumer. This Limited Warranty gives you specific legal rights in addition to your statutory rights under applicable consumer protection laws. These statutory rights may vary depending on the laws of your country of residence and are not affected by this
warranty.
Some jurisdictions do not allow limitations on, or exclusions of, certain implied terms and conditions, or liabilities. In those cases, this Limited Warranty does not affect, limit or exclude any statutory rights you may have. Prompt return of a completed warranty registration form will help protect your warranty rights. Registration requirements do not apply to residents of jurisdictions where prohibited by law.

GENERAL

Rights of Third Parties

A person who is not party to this Limited Warranty may not enforce any term of this Limited Warranty under the Contracts (Rights of Third Parties) Act 1999.


Invalidity

If a competent court or administrative body finds that any provision of this Limited Warranty is invalid illegal or unenforceable, it will be excluded from the warranty and the rest of this Limited Warranty
shall remain unaffected and in force.

Assignment

You may not assign, transfer, mortgage, charge, subcontract, delegate, declare a trust over or deal in
any other manner with any of your rights and obligations under this Limited Warranty.


GOVERNING LAW AND JURISDICTION


This Limited Warranty, and any non-contractual obligations arising from or connected with this Limited Warranty, is governed by and construed under Dutch law, without prejudice to any rights you may have under applicable mandatory laws. You and Bullfrog irrevocably agree that the court of
Amsterdam have exclusive jurisdiction to settle any dispute (whether contractual or non-contractual) arising out of or in connection with this Limited Warranty, including as to its existence, validity or termination, unless mandatory applicable laws grant you the right to opt for dispute resolution by a court that would otherwise have jurisdiction under the applicable law.

ATTREZZATURA
Questa garanzia copre specificamente la/e pompa/e, il riscaldatore, il sistema di controllo, il FilterCap™, altre apparecchiature meccaniche Bullfrog (escluse le apparecchiature elencate in altre sezioni) e le perdite da qualsiasi componente o raccordo idraulico situato sotto il guscio della spa.
Le apparecchiature elettriche e meccaniche con le relative tubazioni e raccordi sono garantite contro difetti nei materiali e nella lavorazione per tre anni dalla data di acquisto.
I componenti difettosi che possono essere facilmente rimossi dalla spa e che possono essere facilmente sostituiti dal cliente e non richiedono strumenti o conoscenze specializzate o creano problemi di sicurezza personale, tutti denominati componenti facilmente rimovibili, saranno riparati o sostituiti gratuitamente presso il vostro
rivenditore autorizzato Bullfrog Spas. Questa garanzia esclude i sistemi audio, i sistemi di cura dell’acqua e i sistemi di illuminazione interna ed esterna della spa.
MOBILE SPA e BASE
Questa garanzia copre specificamente gli angoli dell’armadio, la porta e i pannelli laterali e la base della spa sagomata.
Le sezioni dell’armadio (angoli, porte, pannelli laterali) sono garantite contro il degrado e le fessurazioni per tre anni dalla data di acquisto.
EnduraBase™ è garantito contro il degrado e le fessurazioni per tre anni dalla data di acquisto. Gli articoli difettosi saranno riparati secondo i termini di questa garanzia.

1 ANNO DI GARANZIA

COPERTURA SPA PATIO PERFORMANCE™
Bullfrog garantisce la copertura della spa Patio Performance contro difetti nei materiali o nella lavorazione, a meno che non si tratti di normale sbiadimento o usura, per 1 anno dalla data di acquisto della spa originale.

2 ANNI DI GARANZIA

ILLUMINAZIONE
Bullfrog garantisce i sistemi di illuminazione interna ed esterna della spa contro difetti di materiali e lavorazione per due anni dalla data di acquisto originale della spa. Componenti di illuminazione facilmente rimovibili I componenti, come le luci esterne dell’applique, verranno riparati o sostituiti gratuitamente presso il rivenditore autorizzato Bullfrog Spa.
IMPIANTI AUDIO
Bullfrog garantisce i sistemi audio contro difetti nei materiali e nella lavorazione per due anni dalla data di acquisto originale della spa.
SISTEMI PER LA CURA DELL’ACQUA
Bullfrog garantisce i sistemi di cura dell’acqua contro difetti nei materiali e nella lavorazione per due anni dalla data di acquisto originale della spa.

ALTRE GARANZIE

Bullfrog garantisce i cuscini, le facce in metallo e i filtri Bullfrog Spa contro difetti di materiali e lavorazione al momento della consegna.

GARANZIA PRESTAZIONI e TERMINI

Bullfrog o il suo agente autorizzato (ad esempio, il personale di Bullfrog, dei suoi rivenditori al dettaglio o delle sue società di servizi di terze parti autorizzate) riparerà o sostituirà qualsiasi componente malfunzionante o difettoso della spa Bullfrog che sia coperto dai termini della presente Garanzia Limitata e sia stato acquistato da un rivenditore o negozio al dettaglio autorizzato Bullfrog Spas. A tal fine, Bullfrog si riserva il diritto, a sua discrezione, di riparare o sostituire la spa o il componente difettoso. Il proprietario è tenuto a mantenere un accesso libero alla stiva delle attrezzature termali ed è responsabile di eventuali costi non standard per l’accesso alle attrezzature termali.
Se Bullfrog o il suo agente autorizzato determina che la riparazione del difetto non è fattibile, Bullfrog o il suo agente autorizzato possono invece fornire una spa o un componente sostitutivo di valore uguale alla spa o al componente difettoso. Nei casi in cui sia autorizzata una spa sostitutiva, Bullfrog cercherà di sostituire la spa con una di pari valore di mercato. Se autorizzato da Bullfrog, potresti anche essere autorizzato a
Scegli una spa più costosa pagando la differenza tra il valore di mercato della tua spa originale al momento dell’acquisto e il prezzo di mercato attuale della nuova spa sostitutiva.
Il Proprietario sarà responsabile di eventuali costi non standard per la rimozione e la sostituzione della spa, come le spa situate in un caveau, le spa situate su un balcone o un ponte dove è richiesta una gru o la riparazione o la sostituzione del decking. Trascorsi sei mesi dalla data di acquisto originale della spa, il Proprietario sarà responsabile di tutti i costi per la rimozione e la sostituzione del prodotto difettoso, delle spese di chilometraggio del rivenditore, dei costi di spedizione del prodotto sostitutivo e della consegna. In caso di guasto della struttura o del telaio dopo tre anni dalla data di acquisto della spa originale, la spa difettosa deve essere inviata al rivenditore autorizzato Bullfrog Spa per la riparazione a spese del proprietario. In alcune situazioni, il rivenditore di assistenza o Bullfrog possono
addebitare al Proprietario una ragionevole commissione di servizio.
Bullfrog si riserva il diritto di utilizzare componenti di ricambio nuovi o ricondizionati. Qualsiasi riparazione o sostituzione di componenti o spa non riceve una copertura di garanzia nuova o estesa, ma è coperta solo dalla parte rimanente del periodo di garanzia del prodotto originale.
Per ottenere il servizio di garanzia, contattare il rivenditore autorizzato Bullfrog Spas e inviare la prova d’acquisto. Il requisito della prova d’acquisto può essere derogato se i registri di Bullfrog o del rivenditore possono confermare la data di acquisto originale della spa e che tu sei l’acquirente originale. Qualsiasi spa o componente difettoso inviato direttamente al rivenditore per la riparazione in garanzia deve essere pre-autorizzato dal rivenditore o da Bullfrog e deve essere prepagato in porto assegnato. Il trasporto di ritorno sarà a carico di Bullfrog per tutti i componenti e le spa in garanzia, ad eccezione di qualsiasi spa restituita che sia trascorsa più di tre anni dalla data di acquisto. Se l’intera spa viene restituita al rivenditore per la riparazione, tutti i costi di rimozione e reinstallazione della spa presso la sede del Proprietario saranno a carico del Proprietario. Nella misura massima consentita da
legge applicabile, la riparazione o la sostituzione, come descritto sopra, sarà di esclusiva responsabilità di Bullfrog e l’unico ed esclusivo rimedio dell’utente per qualsiasi violazione della presente Garanzia Limitata.

ESCLUSIONI

La presente Garanzia Limitata Bullfrog Spa è nulla nelle seguenti circostanze:
 La spa è stata oggetto di alterazione, negligenza, uso improprio o abuso, o di alterazioni che ne causano il danno.
 Il danno è causato da lavori di riparazione o manutenzione che sono stati tentati o eseguiti da persone diverse da un agente autorizzato di Bullfrog.
 La spa è stata utilizzata in un luogo non residenziale o commerciale (anche quando una spa può essere utilizzata da più residenti di un complesso di appartamenti o villette a schiera) o in qualsiasi modo per cui non è stata progettata.
 Il danno è causato da un atto di Dio (incendio, terremoto, calamità naturale o qualsiasi altra causa esterna), animale o da qualsiasi azione o omissione attribuibile all’utente.
 I danni sono causati dall’aggiunta o dall’uso di qualsiasi componente meccanico o elettrico non approvato o di sostanze chimiche.
 I danni sono causati da spedizione, spostamento, uso improprio, installazione impropria o collegamento elettrico da parte di persone diverse da un agente autorizzato di Bullfrog.
 I danni all’involucro della spa sono causati da un eccessivo accumulo di calore dovuto alla mancata copertura adeguata della spa quando è priva d’acqua o esposta alla luce solare diretta o ad altre condizioni atmosferiche.
 Il funzionamento della spa al di fuori dell’intervallo di temperatura dell’acqua è causato da un danno compreso tra 40°F e 110°F (4°C-43°C).
 I danni sono causati da una manutenzione impropria della chimica dell’acqua termale o dal fatto che i prodotti chimici della spa non disciolti si depositano sulla superficie della spa.
 Il danno è causato dalla mancata installazione, manutenzione e funzionamento della spa in conformità con le raccomandazioni contenute nel Manuale dell’utente Bullfrog, nella Guida alla pre-consegna o in qualsiasi altra istruzione stampata, avviso o bollettino di Bullfrog.
Qualsiasi persona o azienda può eseguire la manutenzione o le riparazioni necessarie su una spa Bullfrog. Tuttavia, eventuali danni causati dall’utente o da chiunque non sia Bullfrog o i suoi agenti autorizzati non sono coperti e possono invalidare la presente Garanzia Limitata.

NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE APPLICABILE, LA PRESENTE GARANZIA LIMITATA STABILISCE L’ESCLUSIVA RESPONSABILITÀ E OBBLIGO DI BULLFROG PER EVENTUALI PROBLEMI O MALFUNZIONAMENTI DELLA SPA E PER EVENTUALI VIOLAZIONI DELLA GARANZIA E LA PRESENTE GARANZIA LIMITATA SOSTITUISCE TUTTE LE ALTRE GARANZIE, CONDIZIONI E ALTRI TERMINI NON STABILITI NELLA PRESENTE GARANZIA LIMITATA, CHE SONO ESPRESSAMENTE ESCLUSI. NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE APPLICABILE, QUALSIASI GARANZIA IMPLICITA (COME LE GARANZIE IMPLICITE DI COMMERCIABILITÀ E IDONEITÀ PER UNO SCOPO PARTICOLARE) È LIMITATA AL PERIODO LEGALE O ALLA DURATA DELLA GARANZIA APPLICABILE SOPRA INDICATA, A SECONDA DI QUALE SIA LA PIÙ BREVE. NESSUN AGENTE, RIVENDITORE, DISTRIBUTORE,
LA SOCIETÀ DI SERVIZI O ALTRA PARTE È AUTORIZZATA A CAMBIARE, MODIFICARE O ESTENDERE I TERMINI DELLA PRESENTE GARANZIA LIMITATA IN QUALSIASI MODO. LA PRESENTE GARANZIA LIMITATA TERMINA AL MOMENTO DEL TRASFERIMENTO DELLA PROPRIETÀ DELLA SPA.

RINUNCE

NULLA DI QUANTO CONTENUTO NELLA PRESENTE GARANZIA LIMITATA ESCLUDE LA RESPONSABILITÀ DI BULLFROG PER MORTE O LESIONI PERSONALI CAUSATE DA NEGLIGENZA, FRODE O FALSA DICHIARAZIONE FRAUDOLENTA DI BULLFROG E QUALSIASI ALTRA RESPONSABILITÀ CHE NON PUÒ ESSERE ESCLUSA DALLA LEGGE.
AD ECCEZIONE DI QUANTO STABILITO NELLA PRESENTE GARANZIA LIMITATA O ALTRIMENTI RICHIESTO DALLA LEGGE APPLICABILE, BULLFROG E I SUOI AGENTI AUTORIZZATI NON SARANNO RESPONSABILI PER: (A) EVENTUALI LESIONI PERSONALI, MORTE O DANNI ALLA PROPRIETÀ; O (B) QUALSIASI PERDITA O COSTO INDIRETTO, INCIDENTALE, CONSEQUENZIALE, SPECIALE O PUNITIVO, DERIVANTE DAI PRODOTTI DELLE SPA, DI BULLFROG O DEI SUOI AGENTI
O SERVIZI, O QUALSIASI DIFETTO COPERTO DALLA PRESENTE GARANZIA LIMITATA, INCLUSI, A TITOLO ESEMPLIFICATIVO MA NON ESAUSTIVO, LA PERDITA DI UTILIZZO DELLA SPA E IL COSTO PER LA RIMOZIONE DEI PRODOTTI DIFETTOSI, ANCHE SE BULLFROG È STATA AVVISATA DELLA POSSIBILITÀ DI TALI DANNI.
SALVO QUANTO RICHIESTO DALLA LEGGE, LA RESPONSABILITÀ TOTALE DI BULLFROG E DEI SUOI AGENTI AUTORIZZATI NEI CONFRONTI DELL’UTENTE O DI TERZI DERIVANTE DA O IN CONNESSIONE CON LA PRESENTE GARANZIA LIMITATA, SIA CHE DERIVI DA CONTRATTO, ILLECITO (INCLUSA LA NEGLIGENZA), VIOLAZIONE DI OBBLIGHI DI LEGGE O ALTRO NON SUPERERÀ L’IMPORTO ORIGINARIAMENTE PAGATO DALL’UTENTE PER IL DIFETTO
PRODOTTO. LA COPERTURA AI SENSI DELLA PRESENTE GARANZIA LIMITATA DECORRE DALLA DATA DI ACQUISTO ORIGINALE E NON SI ESTENDERÀ PER NESSUN MOTIVO OLTRE I PERIODI DI TEMPO INDICATI.

DIRITTI LEGALI CONSUMATORI

Quanto segue si applica solo se l’utente è qualificabile come consumatore. La presente Garanzia Limitata conferisce all’utente diritti legali specifici in aggiunta ai diritti legali previsti dalle leggi applicabili in materia di protezione dei consumatori. Questi diritti legali possono variare a seconda delle leggi del paese di residenza dell’utente e non sono influenzati da questa garanzia.
Alcune giurisdizioni non consentono limitazioni o esclusioni di determinati termini e condizioni impliciti o responsabilità. In tali casi, la presente Garanzia Limitata non pregiudica, limita o esclude alcun diritto legale che l’utente possa avere. La pronta restituzione di un modulo di registrazione della garanzia compilato aiuterà a proteggere i tuoi diritti di garanzia. I requisiti di registrazione non si applicano ai residenti delle giurisdizioni in cui è proibito dalla legge.

GENERALE

Diritti di terzi

Una persona che non è parte della presente Garanzia Limitata non può far valere alcun termine della presente Garanzia Limitata ai sensi del Contracts (Rights of Third Parties) Act 1999.

Invalidità

Se un tribunale o un organo amministrativo competente ritiene che una qualsiasi disposizione della presente Garanzia limitata non sia valida, illegale o inapplicabile, sarà esclusa dalla garanzia e il resto della presente Garanzia limitata rimarrà inalterato e in vigore.

Incarico

L’utente non può cedere, trasferire, ipotecare, addebitare, subappaltare, delegare, dichiarare un trust o trattare in qualsiasi altro modo con i propri diritti e obblighi ai sensi della presente Garanzia limitata.

LEGGE APPLICABILE E GIURISDIZIONE

La presente Garanzia Limitata, e qualsiasi obbligo extracontrattuale derivante o connesso alla presente Garanzia Limitata, è regolata e interpretata ai sensi della legge olandese, fatti salvi i diritti che l’utente può avere ai sensi delle leggi obbligatorie applicabili. L’utente e Bullfrog concordano irrevocabilmente che il tribunale di Amsterdam ha giurisdizione esclusiva per la risoluzione di qualsiasi controversia (contrattuale o extracontrattuale) derivante da o in relazione alla presente Garanzia Limitata, anche per quanto riguarda la sua esistenza, validità o risoluzione, a meno che le leggi applicabili obbligatorie non concedano all’utente il diritto di optare per la risoluzione delle controversie da parte di un tribunale che avrebbe altrimenti giurisdizione ai sensi della legge applicabile.

Bullfrog garantisce il sistema di illuminazione della spa contro difetti nei materiali e nella lavorazione per un anno dalla data di acquisto originale della spa. I componenti difettosi che possono essere facilmente rimossi dalla spa e che sono considerati componenti facilmente rimovibili, saranno riparati o sostituiti gratuitamente presso il rivenditore autorizzato Bullfrog Spa o inviando i componenti difettosi a Bullfrog.

Sistema audio

Bullfrog garantisce i sistemi audio contro difetti nei materiali e nella lavorazione per un anno dalla data di acquisto originale della spa.

Sistema ad ozono

Bullfrog garantisce il sistema a ozono contro difetti nei materiali e nella lavorazione per un anno dalla data di acquisto originale della spa.

Superficie del guscio

Bullfrog garantisce che la finitura superficiale della Bullfrog Spa non si screpola, raggrinzisce, vesciche, si sbuccia o si delamina per tre anni dalla data di acquisto della spa originale.

Impianto idraulico

Bullfrog garantisce che i raccordi del getto, l’impianto idraulico interno, gli scarichi e i tubi flessibili non perdano per tre anni dalla data di acquisto originale della spa.

Armadietto

Bullfrog garantisce gli angoli, le porte e i pannelli laterali dell’armadio contro il degrado e le crepe per tre anni dalla data di acquisto originale della spa. Le macchie superficiali e lo sbiadimento non sono coperti dai termini di questa garanzia.

Attrezzatura

La garanzia copre specificamente la/e pompa/e, il riscaldatore, il sistema di controllo (compresi i fusibili), il FilterCap™, altre apparecchiature meccaniche Bullfrog.

I componenti difettosi che possono essere facilmente rimossi dalla spa e che possono essere facilmente sostituiti dal cliente e che non richiedono strumenti o conoscenze specializzate o creano problemi di sicurezza personale, che sono tutti considerati componenti facilmente rimovibili, saranno riparati o sostituiti gratuitamente presso il rivenditore autorizzato Bullfrog Spa o inviando i componenti difettosi a Bullfrog. Questa garanzia esclude i sistemi audio, il sistema a ozono e i sistemi di illuminazione interni ed esterni della spa.

Copertura Patio Performance™ Spa

Bullfrog garantisce la copertura della spa Patio Performance contro difetti di materiale o di lavorazione per 3 anni dalla data di acquisto della spa originale.

Terme

  • Anno 1: sostituzione dei componenti al 100% e copertura della manodopera.
  • Anno 2: sostituzione dei componenti al 100% e copertura della manodopera.
  • Anno 3: sostituzione dei componenti al 100% e copertura della manodopera.

Illuminazione

Bullfrog garantisce il sistema di illuminazione interna ed esterna della spa contro difetti nei materiali e nella lavorazione per un anno dalla data di acquisto originale della spa. I componenti difettosi che possono essere facilmente rimossi dalla spa, come la lampadina LED esterna (compresa l’applique), che sono considerati componenti facilmente rimovibili, saranno riparati o sostituiti gratuitamente presso il rivenditore autorizzato Bullfrog Spa o inviando i componenti difettosi a Bullfrog.

Sistema audio

Bullfrog garantisce i sistemi audio contro difetti nei materiali e nella lavorazione per un anno dalla data di acquisto originale della spa.

  • La garanzia copre specificamente la/e pompa/e, il riscaldatore, il sistema di controllo (compresi i fusibili), gli SnapCap, il™ FilterCap™, altre apparecchiature meccaniche Bullfrog e le perdite da qualsiasi componente o raccordo idraulico situato sotto il guscio della spa.
  • Le apparecchiature elettriche e meccaniche con le relative tubazioni e raccordi sono garantite contro difetti nei materiali e nella lavorazione per cinque anni dalla data di acquisto.
  • I componenti difettosi che possono essere facilmente rimossi dalla spa e che possono essere facilmente sostituiti dal cliente e non richiedono strumenti o conoscenze specializzate o creano problemi di sicurezza personale, tutti considerati componenti facilmente rimovibili, saranno riparati o sostituiti gratuitamente presso il rivenditore autorizzato Bullfrog Spa o inviando i componenti difettosi a Bullfrog. Questa garanzia esclude i sistemi audio, il sistema di purificazione dell'ozono e i sistemi di illuminazione interni ed esterni della spa.

EternaWood Armadio

  • La garanzia copre specificamente gli angoli dell'armadio, la porta e i pannelli laterali e la base della spa modellata.
  • Le sezioni dell'armadio EternaWood (angoli, porte, pannelli laterali) e EnduraBase™ sono garantite contro il degrado e le crepe per cinque anni dalla data di acquisto. Gli articoli danneggiati saranno sostituiti secondo i termini della presente garanzia.

Sistema terapeutico JetPak

  • La garanzia copre specificamente i getti, eventuali perdite dai raccordi dei getti JetPak e tutti gli impianti idraulici JetPak.
  • Sistema idraulico JetPak garantito per cinque anni dalla data di acquisto.
  • La disponibilità dei colori sui JetPak di ricambio e aftermarket è garantita per un minimo di un anno. (La disponibilità del colore oltre un anno dipende dalla domanda del mercato e dalla disponibilità del colore per Bullfrog.)
